Morgan Stanley sues Ex-FrontPoint manager over insider charges

NEW YORK (Reuters) - Morgan Stanley is suing a former employee who was convicted of insider trading in order to recover $33 million it said it paid U.S. regulators to settle civil claims relating to the crimes, court papers showed.

In a complaint filed in Manhattan federal court on October 31, Morgan Stanley sued ex-FrontPoint Partners hedge fund manager Joseph "Chip" Skowron over the funds the bank paid to the U.S. Securities and Exchange Commission. The lawsuit also called for unspecified compensatory and punitive damages.

Doctor-turned-stock picker Skowron pleaded guilty in August to trading stock of Human Genome Sciences Inc in 2008 based on non-public information he admitted to having received from a consultant for the biotech company, who also pleaded guilty to insider trading charges.

Skowron was sentenced to five years in prison and ordered to forfeit $5 million.

"Beyond the harm attendant to having one of its managing directors plead guilty to serious criminal conduct, the firm expended its own reputational capital by defending Skowron during the years it believed, based entirely on his misrepresentation, that he had not violated the law," the complaint said.

Morgan Stanley - which acquired FrontPoint in 2006 - had sought nearly $45 million from Skowron over his fraud, but a U.S. judge in March said the bank was not entitled to recoup the $33 million SEC payment.

Manhattan federal court judge Denise Cote instead ordered Skowron to pay $10.2 million in restitution to his former employer. Skowron has appealed that order.

Lawyers for Morgan Stanley and for Skowron did not immediately return calls seeking comment.

The case is Morgan Stanley v. Joseph "Chip" Skowron, U.S. District Court for the Southern District of New York, No. 12-cv-8016.

(AP) ? The scandal that brought down CIA Director David Petraeus started with harassing emails sent by his biographer and paramour, Paula Broadwell, to another woman, and eventually led the FBI to discover the affair, U.S. officials told The Associated Press on Saturday.

Petraeus quit Friday after acknowledging an extramarital relationship.

The official said the FBI investigation began several months ago with a complaint against Broadwell, a 40-year-old graduate of the U.S. Military Academy and an Army Reserve officer. That probe led agents to her email account, which uncovered the relationship with the 60-year-old retired four-star general, who earned acclaim for his leadership of the wars in Iraq and Afghanistan.

The identity of the other woman and her connection with Broadwell were not immediately known.

Concerned that the emails he exchanged with Broadwell raised the possibility of a security breach, the FBI brought the matter up with Petraeus directly, according to the official, who spoke on condition of anonymity because he was not authorized to publicly discuss the investigation. The FBI approached the CIA director because his emails in the matter were in most instances sent from a personal account, not his CIA one.

Petraeus decided to quit, abruptly ending a high-profile career that might have culminated with a run for the presidency, a notion he was believed to be considering.

Petraeus handed his resignation letter to President Barack Obama on Thursday, stunning many in the White House, the CIA and Congress. The news broke in the media before the House and Senate intelligence committees were briefed, officials say.

By Friday evening, multiple officials identified Broadwell, who spent the better part of a year reporting on Petraeus' time in Afghanistan.

Members of Congress said they want answers to questions about the affair that led to Petraeus's resignation.

House intelligence committee chairman Mike Rogers, R-Mich., and ranking member Dutch Ruppersberger, D-Md., will meet Wednesday with FBI deputy director Sean Joyce, and CIA acting director Michael Morell to ask questions, including how the investigation came about, according to a senior congressional staffer who spoke anonymously because he was not authorized to discuss the investigation publicly.

Petraeus has been married for 38 years to Holly Petraeus, the daughter of the West Point superintendent when he was a student at the New York school.

"He is truly remorseful about everything that's happened," said Steve Boylan, a retired army officer and former Petraeus spokesman who spoke Saturday with the former general. In a phone call with Boylan, Petraeus lamented the damage he'd done to his "wonderful family" and the hurt he'd caused his wife.

"He screwed up, he knows he screwed up, now he's got to try to get past this with his family and heal," said Boylan.

Paula Broadwell interviewed the general and his close associates intensively for more than a year to produce the best-selling biography, "All In: The Education of General David Petraeus," which was written with Vernon Loeb, a Washington Post editor, and published in January. Since Petraeus's resignation, the book jumped from a ranking on Amazon of 76,792 on Friday to 111 by mid-Saturday.

The CIA was not commenting on the identity of the woman with whom Petraeus was involved.

Broadwell, who is married with two young sons, has not responded to multiple emails and phone messages. Broadwell planned to celebrate her 40th birthday party in Washington this weekend, with many reporters invited. But her husband emailed guests to cancel the event late Friday.

CIA officers long had expressed concern about Broadwell's unprecedented access to the director. She frequently visited the spy agency's headquarters in Langley, Va., to meet Petraeus in his office, accompanied him on his punishing morning runs around the CIA grounds and often attended public functions as his guest, according to two former intelligence officials.

As a military intelligence officer in the Army Reserve, Broadwell had a high security clearance, which she mentioned at public events as one of the reasons she was well-suited to write Petraeus's story.

But her access was unsettling to members of the secretive and compartmentalized intelligence agency, where husbands and wives often work in different divisions, but share nothing with each other when they come home because they don't "need to know."

In one incident that caught the CIA staff by surprise, Broadwell posted a photograph on her Facebook page of Petraeus with actress Angelina Jolie, taken in his 7th floor office where only the official CIA photographer is permitted to take photos. Petraeus had apparently given Broadwell the photo just hours after it was taken.

Petraeus' staff in Afghanistan similarly had been concerned about the time Broadwell spent with their boss on her multiple reporting visits to the war zone. Following standard military procedure with senior officers, they almost always had another staffer present when she met with him at his headquarters, though they did have some meetings alone. Military officers close to him insist the affair did not begin when he was in uniform.

In the preface to her book, Broadwell said she first met Petraeus in the spring of 2006. She was a graduate student at the Kennedy School of Government at Harvard; he was visiting the university to discuss his experiences in Iraq and a new counterinsurgency manual he was working on.

She had graduated from West Point with academic, fitness, and leadership honors, according to a biography posted on her publisher's website that lists authors available for speaking engagements.

Harvard invited some students to meet with Petraeus, and Broadwell was among them because of her military background, which she wrote included being recalled to active duty three times to work on counterterrorism issues after the Sept. 11 attacks.

After Obama put Petraeus in charge in Afghanistan in 2010, Broadwell decided to expand her research into an authorized biography.

Broadwell has deep ties and friendships throughout the Washington media sphere and often was sought for comment on Petraeus' viewpoints as he proved harder and harder to reach.

The CIA director had lowered his media profile, stopping his practice of emailing reporters and ending once-common background interviews by the agency. That was especially the case after GOP allegations last spring that the Obama administration was leaking sensitive material to burnish its foreign policy reputation ahead of the presidential election, after a series of stories appeared about top secret operations aimed at al-Qaida in Yemen, and Iran's nuclear program. A White House-ordered investigation of those leaks continues.

Petreaus's resignation comes just before a crucial scheduled appearance before congressional intelligence committees next week to testify on what the CIA knew, and what it told the White House, before, during and after the attacks that killed the U.S. ambassador and three other Americans in Libya on Sept. 11.

Congressional officials say Petraeus' deputy, Michael Morell, will testify instead, as acting director of the CIA.

Rockville ? Solano Community College is currently presenting a theatrical production, Of Mice and Men, by John Steinbeck, which comes to its final day of production on November 11.

George Maguire, who started his journey back in 1987 teaching at SCC, will be adding this show to his total of 50 and finishing his SCC legacy when he retires at the end of the semester.

The SCC production is a compelling tear jerker, with professional quality acting by the lead performers and cinematic stage effects.

The story takes place on a ranch near Salinas, California back in 1942 following the Great Depression. Two companions, George Milton (Henry Swenson) and Lennie Small (Semaj D. Barnes and Christopher Raymond) would travel looking for work. They would leave a city in Northern California, heading south to Central California. During this time, the two would end up in a town that was in need of a few hands.

The Boss (Mike Glynn and George Nixon) hires the two, but quickly Curley, the Boss? son (Levi Duncan) encounters the two over a jealous rage that he created because of his wife. Curley?s wife, (Cady Dillman and Mikkel Simons) is a handful, flirting with every worker on the farm and just trying to seek attention. Curly goes around threatening all the workers, but then tangles up with Lennie and ends up getting his hand crushed.

Lennie and George discuss the dream of owning their own plantation.? When Curley?s wife is fed up of not getting the attention she wants, she attempts to runaway, but along the way runs into Lennie and has a conversation. She lets Lennie stroke her hair when all of a sudden he becomes obsessed and the two start to start to scuffle with Lennie accidently killing the wife.

The group of men working for the Boss and Curley go on a manhunt searching for Lennie with their guns loaded. George, caught in the middle of not wanting another man to hurt his friend, but knowing he won?t be able to save Lennie decides to search for him as well.

George finds Lennie, coaxes him into coming out of hiding and relaxes his ease by distracting him with the future plans pointing out into the stars and then without warning, passionately shoots him in the back of his head.

A few months back Sprint's Android customers gained the option to charge Google Play purchases to their monthly wireless bill. In an effort to keep the carrier billing party going, the Now Network will soon be adding this option for Spotify Premium customers. An anonymous tipster has shared with us that starting on November 11th, Sprint's Android clientele will be able to add the music streaming service's $10 monthly charge to their bill. While we're sure that some customers will take advantage of this new option, we can't help but long for the good old days when people could bill a new phone to their account. Ah, Sprint giveth and taketh away.

WASHINGTON ? Trying to show flexibility without slowing down President Barack Obama's health care law, the administration said Friday states can have more time to work out their roles in providing health care to millions of uninsured Americans.

In a letter to governors, Health and Human Services Secretary Kathleen Sebelius said she still wants to hear by the end of next week if states will be setting up health insurance markets under the law. But governors can now take another month, until mid-December, to submit detailed blueprints.

The new insurance exchanges will allow households and small businesses to buy a private health plan, and many will get help from the government to pay their premiums. Under the law, states that can't or won't set up exchanges will have theirs run by Washington.

But many governors and state lawmakers were on the fence, awaiting the outcome of the presidential election. And the lost time left them fewer options.

In a concession to procrastinators, Sebelius said states considering a partnership with the federal government to run their exchanges can now have until mid-February to make a decision and submit their blueprints.

The partnership option allows states to handle consumer relations and oversight of health plans, while the federal government does the heavy lifting, taking care of enrollment, and figuring out any taxpayer help that consumers may be entitled to.

Sebelius stressed, however, that she is not waiving any hard deadlines under the law.

"Consumers in all fifty states and the District of Columbia will have access to insurance through these new marketplaces on January 1, 2014, as scheduled, with no delays," she wrote. Open enrollment for exchange plans will start in about 11 months, Oct. 1, 2013.

A check by The Associated Press found 17 states and the District of Columbia on track to setting up their own exchanges, while 10 have decided not to do so.

The states on track include California, Colorado, Connecticut, Hawaii, Kentucky, Maryland, Massachusetts, Minnesota, Mississippi, Nevada, New York, Oregon, Rhode Island, Utah, Vermont, Washington, and West Virginia.

Not setting up exchanges are Alaska, Florida, Louisiana, Maine, New Hampshire, South Carolina, South Dakota, Texas, Virginia, and Wisconsin. Missouri and others are likely to join the list. The federal government could end up running the show in half or more of the states.

An Unknown Number of Twitter Accounts Have Been Compromised, Time to Change Your PasswordsTechCrunch is reporting that a number of users received an email from Twitter this morning claiming their account was compromised and that they should change their passwords now. Many users are also finding spammy tweets coming from their account that they didn't send.

A quick search for people tweeting about password problems shows that the issue is fairly widespread, though Twitter has not yet said how many people were affected. With so little information to go on from Twitter, we'd say it's a safe time to change your password, revoke access to unused Twitter apps, and make sure you're using safe security practices.
