Prior to writing this article, I?ve asked my Virtual Assistants (VA?s from now on) to conduct a research on outsourcing, find me 5 top bloggers in this niche, get me the wikipedia facts and get me on the course of writing this article. After witnessing the results for myself, I?ve seen that hiring and running a team of VA?s is the right direction when running an online business, and ultimate productivity booster for digital entrepreneurs.

The time for outsourcing is just right. There was not a better time in history of the world for entrepreneurs to have more opportunities at having their business succeed in times of struggling economy, even on a low budget. Especially for young, talented, technologically savvy people.

As an individual, you can pioneer into the low cost zone of personal outsourcing, and make the amazing leverage. Trading your money for time of other people, so you can focus on reducing time in office, reducing stress, and generally start living.

If you are capable of identifying low value work, turn it into a process, define it, and communicate it clearly to your assistants, you are creating a leverage on your professional life. If you combine outsourcing with CORE system, it gets ridiculously easy. But outsourcing is a skill set by itself, and will take time for you to learn it, and apply it. Welcome to the latest issue of This Week in Social Media Law, my weekly roundup of issues at the intersection of social media and the law.

On tap this week: ownership of social media accounts, teachers and online relationships, cybersecurity awareness, Canada?s anti-spam law, and the Children?s Online Privacy Protection Act. For your liking, tweeting, sharing, recommending, and plus one-ing pleasure:

Yours, mine, and ours ? whose accounts are they, anyway?

The legal battle over the ownership of social media accounts is just beginning, and it?s likely to be a messy fight. Case in point: the most recent lawsuit, Linda Eagle?s dispute with her former employer Edcomm over her LinkedIn account, involves issues that touch on a wide range of federal and state laws, including the Computer Fraud and Abuse Act (the federal anti-hacking law), trademark law (related to confusion or the likelihood of confusion), and state law claims relating to conversion (regarding a company laptop), misappropriation (of the account), and invasion of privacy.

Attorneys Martha Zackin and Brandon Willenberg (law firm Mintz Levin) think that a clear and comprehensive social media policy can help clean up the mess before it starts. Travis Crabtree (from law firm Looper Reed) agrees, but wonders if fighting over social media accounts is worth the trouble:

?It seems to me that Eagle is spending a lot of efforts for loss of access to her account for 22 weeks? What was the real damage? From Edcomm?s perspective, what was the real gain? If there were trade secrets on the account, there are prohibitions and ways to address that without seizing the entire account (or at least seizing it for that long).?

Beware the ?Parental Paparazzi?

Should teachers be ?friends? with the parents of their students? Probably not, writes Jackie Wernz from law firm Franczek Radelet, because it could expose the teachers ? and the school districts they work for ? to a wide range of unintended consequences. Like charges of misconduct for posts deemed inappropriate by the ?parental paparazzi,? or confusion over official and unofficial school-related communications. Perhaps not surprisingly, Wernz advocates for policies, procedures, and guidelines that cover social networking (without crossing the line drawn by the NLRB, of course). But the best answer might be to just say ?no.? (Franczek Radelet)

October is National Cybersecurity Awareness Month

But it may be too early to start celebrating. President Obama?s proclamation of October as National Cybersecurity Awareness Month is a reminder, write Amy Malone and Cynthia Larose of law firm Mintz Levin, that everyone ? from individuals to government agencies to small businesses to law enforcement ? needs to understand cyber threats and take measures to protect online privacy and security. (You don?t have to take their word for it: the FBI and the country?s top three financial institutions will tell you the same thing.) Don?t expect National Cybersecurity Awareness month to be the end of it, however. Growing concern is leading the government to take a more active role in addressing cybersecurity issues, which is likely to include an executive order on cybersecurity?that covers some of the same ground as the failed Cybersecurity Act of 2012.?

How do you say ?anti-spam? in French Canadian?

Canada?s anti-spam law is scheduled to take effect in 2013, but businesses can start preparing now (even if all of the rules haven?t been finalized). The Canadian Radio-television and Telecommunications Commission just issued two information bulletins on its rules, which cover obtaining consent and effective unsubscribe mechanisms. Who says social media and internet law isn?t sexy?

At this rate, the rules may never catch up with the technology?

After more than two years in the making, the Federal Trade Commission?s recommended changes to the Children?s Online Privacy Protection Act could be finalized by the end of the year. The FTC wants the rules to include mobile devices, geo-location information, and behavioral advertising tracking cookies, and to make the rules applicable to a broader range of websites. 7 Simple Parenting Strategies That Work | World of Psychology

7 Simple Parenting Strategies That Work If you?re a parent, then you are likely interested finding ways to interact with your child or children that create a strong relationship, foster positive behavior, and respond to behavioral problems.

Take a look at any bookstore and the shelves will be full of advice. But figuring out which strategies are actually effective can be a challenge.??

In this month?s American Psychological Association?s Monitor on Psychology, Amy Novotney asks leaders in child psychology about the best parenting strategies. ?Her quest was not for someone?s idea of the best way to parent, but for strategies backed by research studies showing their effectiveness in improving behavior, strengthening the bond between parents and children, and reacting behavioral problems that arise.

The following seven empirically tested parenting strategies were the result.

  1. Provide Labeled Praise.? Studies have shown that the behavior that gets attention is the behavior that you?ll get more of. Attention to undesired behavior ? often in the form of reprimands or punishment ? will increase undesired behavior.? At the same time, specific, labeled praise of desired behaviors increase that behavior.? Parents should not offer praise indiscriminately, says Sheila Eyberg, PhD, a psychology professor who conducts research on parent-child relationships.? Instead, parents should give specific feedback on exactly what the child did that the parent liked.
  2. Ignore Minor Misbehavior.? If a misbehavior is minor and not dangerous, ignore it.? Ignoring when a toddler throws food on the floor or a pre-teen slams a door, while responding with attention when they ask nicely or express their feelings teaches the child that good behavior is a reliable way to get attention (The Kazdin Method for Parenting the Defiant Child).
  3. Become a Student of Child Development.? Understanding developmental milestones can help a parent attend to and praise steps towards that milestone.? Knowing a four-year old wants to please friends will make you more likely to praise their positive behavior with friends.? At the same time, understanding that young teens typically have concerns about body image, looks and clothes might make it easier to ignore all that extra time spent in front of the mirror.
  4. Do Time-Outs Right Along With Quality Time-In.? Brief and immediate time-outs have been shown to work best, particularly when paired with parents who are also modeling positive behaviors and praising good behavior.? Keeping calm ? often a real challenge at the moment a misbehavior is occurring! ? and praising compliance makes time-outs more effective.
  5. Focus on Prevention of Misbehavior.? Paying attention to when a child gets tired or hungry can prevent a large portion of meltdowns.? Planning ahead and anticipating potential problems and teaching a child strategies to cope with problems when they arise can even eliminate the need to use time-outs, says John Lutzker, PhD, the director of the Center for Healthy Development at Georgia State University.
  6. Take Care of Yourself First.? According to a 2010 APA study, children are negatively affected by parental stress, with 86 percent of children reporting that parental stress bothers them.? It can seem nearly impossible when you?re busy with the demands of parenting, work and life, but it is essential to take time to exercise, maintain hobbies and connect with friends and partners.
  7. Take Time and Do Nothing.? Spend time with your child (experts recommend 1 hour a week per child) doing nothing but being with them, acting interested in them, and expressing positive thoughts and feelings to them. ?Avoid teaching, inquiring, correcting or offering alternative perspectives.

At times, parenting can feel like you?re in in an airplane in turbulence in a thunderstorm and the oxygen masks have dropped.? As with on a plane, when parenting it?s important to remain calm, put your oxygen mask on first ? before you help your children and give specific instructions of what to do, with lots of positive feedback for good behavior.

Prop 30 can't save California from debt

Once again, California?s state government is in dire fiscal straits.

In an annual tradition, Californians are bombarded with apocalyptic scenarios of financial doom and gloom over impending budget cuts to popular government programs. In order to shore up this year?s fiscal mess, Gov. Jerry Brown proposes to cover a $16 billion shortfall in the state?s $142 billion budget by cutting $8 billion from the general fund, obfuscating $2.5 billion in several gimmicks and fee increases, and raising $6 billion in new taxes.

However, in 2010,? Brown campaigned not to raise Californians? taxes with one caveat: that the voters approve any such tax hike.

To entice residents to vote for higher taxes in Proposition 30, the governor is playing a clever game of carrot and stick while threatening menacing ?trigger cuts.? If voters fail to raise taxes, they will face a further $6 billion in painful cuts to popular programs to offset the anticipated tax revenue. If they acquiesce to higher taxes, they will be rewarded with kudos from the political class for their self-sacrifice and fewer budget cuts.

The governor?s threatened slashing seems to hit all the right programs to elicit maximum public outcry: $5.3 billion from K-12 education, $250 million each from the UC and CSU systems, $50 million from adult developmental services, $20 million from local police forces, and so on. The CSU system has embraced the same carrot and stick tactic: reject tax increases and face an extra increase in tuition, accept tax increases and see a $498 per student rebate.

Unfortunately, if passed, Proposition 30 will likely only bridge the gap for a short time, since California?s budget problems are chronic and structural, not temporary. Total budget expenditures a decade ago were $100 billion, compared to today?s $142 billion. The four largest outlays in both the 2002-2003 and 2012-2013 budgets are (a) Health and Human Services, (b) K-12 Education, (c) Business, Transportation and Housing, and (d) Higher Education.

Over the last decade, Health and Human Services funding grew from $27.2 billion to $45.4 billion. K-12 Education went from from $31.8 billion to $38.8 billion. Business, Transportation and Housing funding grew a whopping 130.1 percent, from $7.3 billion to $16.8 billion. Sadly, neglected Higher Education funding actually shrank from $11.3 billion to $9.9 billion (but was compensated several times over with higher tuition).

Meanwhile California?s population grew from 33.8 million in 2000 to 37.2 million in 2010, a paltry 10 percent increase.

However altruistic, this explosive growth of spending is clearly unsustainable. The state will likely not abate in the near future, forcing higher education to fight for a shrinking part of the budgetary pie as other programs gobble up more revenue.

Furthermore, the combination of a weaker than national average economic situation and steeper progressive taxes could leave California in a deeper fiscal lurch as the affluent tax base flees to zero percent income tax states like Nevada and Texas, depriving Brown of his lucrative cash cows.

While Proposition 30 might raise some $6 billion in income and sales taxes and act as a temporary stopgap measure, it fails to enact badly needed reform for a bloated system and only enables another year of unsustainable budget busting dysfunction.
